Love My Greece
Terms & Conditions
To ensure good vibes, please read our terms and conditions.
These terms and conditions apply to all retreats run by Love My Greece and Love My New Zealand Art Retreats (together, “Love My Greece”, “we”, “us”), hosted by Sue MacDougall and based in New Zealand. This includes our art & wellness retreats at The Beachhouse Apartments, Vagia, Aegina Island, Greece, and our New Zealand Art Retreat in Tauranga, Bay of Plenty. If you have any questions, contact Sue on +64 21 0239 4549 or at [email protected].
1.0 Payments & Cancellations
1.1 Terms of Service
Love My Greece will list what is and is not included on each retreat and pricing page. International flights (including flights to Athens for our Aegina retreats), travel to Tauranga for our New Zealand retreat, in-transit accommodation, visas, airport taxes, travel insurance, personal spending money, and meals, drinks or activities not listed as included are not included unless we say otherwise.
1.2 Reservations
To reserve your place on one of our retreats, please choose your retreat and room on our Pricing page and complete your payment through our secure payment link, or book a free discovery call with Sue to confirm availability first. Each retreat is limited to a maximum of 8 guests, and places are confirmed in the order payments are received.
1.3 Payment & Acceptance of Terms and Conditions
Love My Greece will consider these Terms and Conditions accepted by any guest who has made a part or complete payment for a retreat. You are not required to sign these terms and conditions to be in acceptance of them. Please note that a signature is required for your photo and video release (section 4.2).
Payments can be made through the secure payment links on our website, either in full or by the 2 or 4 monthly payment options shown for your retreat, or as otherwise agreed in writing with Sue. All prices are per person and shown in New Zealand dollars (NZD). Final balances, including all remaining payment-plan instalments, are due 30 days before the retreat start date. If final payment is not received by 30 days prior to the retreat start date, Love My Greece reserves the right to cancel your reservation and offer your place to someone else. In this case your deposit will be forfeited.
1.4 Cancellation by Guest & Refund Policy
If you wish to cancel your retreat you must notify Sue in writing by email at [email protected]. Your cancellation takes effect once we have received your notice. Please NOTE that we have a strict NO REFUND POLICY. Because our retreats are small and Love My Greece incurs costs as soon as a booking is accepted and paid for, including accommodation, workshop materials, guides and transfers, we reserve the right not to refund monies. Love My Greece may, at its own discretion, offer a refund depending on how long remains until the retreat begins. If there is a reasonable time frame, we will refund less administrative, booking and any non-recoverable supplier costs.
1.5 Cancellation by Love My Greece
We will do our best to make sure all our retreats run without disruption. However, your safety is our priority. In the unlikely event that we have to cancel a retreat, whether due to natural disaster, illness, civil unrest or any other unforeseen circumstance outside our control, guests may transfer their deposit to a future retreat (within 12 months). While we will help as much as we can during this process, we want to be clear so we are on the same page: in the event of a cancelled retreat, Love My Greece is not liable for refunds or reimbursements beyond that transfer, except where the law requires otherwise. Guests can lodge a claim with their travel insurance company for a refund or reimbursement. Travel insurance is a real must to protect you from unforeseen events.
1.6 Changes by Love My Greece
Love My Greece reserves the right to make changes deemed necessary by Sue, our teachers or our partners prior to the retreat start date. If we need to change the venue, a teacher, the itinerary or any other aspect of the retreat, whether due to natural disaster, illness, civil unrest, death, closure or any other unforeseen circumstance, guests may transfer their deposit to a future retreat starting within 12 months of the start date of the current retreat. All other payments will be forfeited and Love My Greece will not be liable for refunding or reimbursing any amount beyond the transfer of the deposit. Love My Greece is not responsible for reimbursing or refunding any amount paid if you decide to cancel because of these changes; this is the responsibility of your chosen travel insurance company and policy. This is exactly why we require travel insurance, in addition to covering medical and travel complications that may occur. You will not be entitled to claim any additional amounts or seek compensation for any loss, expenses or damage (direct or consequential), or for any loss of time or inconvenience resulting from such a change or cancellation (including but not limited to flights, ferry tickets, visa, passport and vaccination charges, gear purchases, and airport and airline taxes).
1.7 Disrupted Travel
It is each guest’s responsibility to hold a valid passport, valid for at least 6 months after the date you intend to return home, and to check whether you need a visa or travel authorisation for Greece (or any country you pass through). For our Aegina retreats, it is also your responsibility to arrive at the agreed meeting point, Piraeus Port, on arrival day. If a guest’s passport, visa, flight or onward travel disrupts their travel, Love My Greece will not be liable for any compensation.
2.0 Insurance & Documentation
2.1 Travel Insurance
Travel insurance is mandatory for all Love My Greece retreats, whether you are travelling overseas to Aegina or joining our New Zealand retreat in Tauranga. Your policy must cover you for the location and dates of your retreat and include medical cover and natural disaster cover. We highly recommend adding ‘Cancel for Any Reason’ cover to receive financial compensation for any reason; for example, a family emergency, a new job opportunity, or if Love My Greece has to cancel due to weather, host illness or injury, or other unforeseen reasons. Standard trip cancellation cover is usually limited to your own illness or injury, or a travel companion’s illness, injury or death. Sue is happy to guide you on what to look for.
2.2 Travel Documents and Immunisations
It is the responsibility of each traveller to obtain all required travel documents, including visas, unless otherwise noted. Information about each retreat is provided on our website, or you can contact Sue for more detail about your retreat requirements. It is your responsibility to obtain any immunisations you need. Please contact your doctor or nearest travel clinic for the latest requirements.
3.0 Acknowledgement
3.1 Acknowledgement of Risks — Assumption of Responsibility
Although Love My Greece has taken reasonable steps to ensure safety, I (the retreat guest) acknowledge that this activity has risks, including some which cannot be eliminated without destroying the unique character of the retreat. The same elements that contribute to the unique character of the retreat can cause loss or damage to the guest, including accidental injury, illness or, in extreme cases, permanent trauma, disability or death, and can also cause damage to or loss of property. The following describes some, but not all, of those risks.
Activities vary from retreat to retreat and may include, but are not limited to: art workshops using paints, brushes, palette knives and other art materials, indoors and outdoors (including painting at the beach); optional yoga sessions; walking on uneven, rocky or steep ground, including at archaeological sites such as the Temple of Aphaia and Kolona; swimming in the sea; travel by ferry, hydrofoil, minivan, car or on foot; and eating and drinking at local restaurants and tavernas, including seafood and local wine.
Our retreats may involve travel to places some distance from medical facilities. Transportation, evacuation and medical care can be delayed, and communication can be delayed, limited or unavailable.
Environmental risks and hazards include deep, cold or moving water and sea currents; sea creatures and insects; uneven and slippery surfaces; strong sun and high summer temperatures; and weather which may change without warning. Possible injuries and illnesses include sunburn, heatstroke, dehydration, allergic reactions, cuts, sprains, falls and other mild or serious conditions.
Throughout the retreat, guests are responsible for their own safety and for any activities they choose to take part in during free time.
I (the retreat guest) acknowledge and understand that Love My Greece retreats include risks of injury or death to guests. I understand the description above is not complete and that other unknown or unanticipated risks may result in property loss, injury or death. I agree to assume responsibility for the inherent risks identified here and those not specifically identified. I acknowledge that participation is purely voluntary, no one is forcing me to participate, and I choose to participate with full knowledge of the inherent risks. I (the retreat guest) assume and accept full responsibility for any injury, death, loss of personal property and expenses suffered as a result of those inherent risks and dangers, identified or not, and as a result of my own negligence in participating in this activity.
4.0 Waiver
4.1 Release and Waiver of Liability
DECLARATION OF HEALTH. By accepting these terms, I (the retreat guest) represent that I have no physical conditions or medical precautions which would adversely affect my ability to take part in the art workshops, yoga, walking, swimming or other physical or cultural activities offered on Love My Greece retreats, or that I have told Sue about any such condition before the retreat. I fully understand that my participation in these activities could be injurious to my health and I voluntarily assume all risks related to them.
PERSONAL RELEASE. By agreeing to the terms outlined here and elsewhere on the Love My Greece website, I release and discharge my rights and claims for damages or liabilities that may occur as a result of participation in a Love My Greece retreat, including but not limited to damages resulting from unexpected occurrences such as weather, local political situations, wildlife or uncontrollable acts of God, including the risk of death. I release Love My Greece, including Sue MacDougall, its teachers, guides, yoga instructors, accommodation providers and partners, from liability for personal injury, illness, emotional damage, incurred travel expenses or property damage I may incur as a result of participation in the retreat.
For the benefit of everyone on the retreat, Love My Greece reserves the right to accept or reject any guest at any time without liability. If we determine, in our sole and exclusive discretion, that a guest is disruptive to the harmony of the retreat, we may remove that guest from the retreat without any obligation to pay a refund or any other amount. Love My Greece carries no responsibility or liability for any guest who leaves the retreat before its conclusion, or for any activity undertaken by any guest which is not included in the retreat itinerary.
4.2 Release and Permission to Photograph and Video
By agreeing to the terms outlined here and elsewhere on the Love My Greece website, I grant permission to Love My Greece to the rights of my image, video or likeness taken during the retreat. I understand that my image may be edited, copied, exhibited, published or distributed, and I waive the right to inspect or approve the finished product in which my likeness appears. I waive any right to royalties or other compensation arising from or related to the use of my image or recording. I understand this material may be used in commercial settings within an unrestricted geographic area, including on our website, in presentations, on online video platforms (YouTube, Vimeo, etc.), in broadcast media and on social media. By signing this release, I (the retreat guest) understand that photographs or video recordings of me may be displayed via the internet or in public business settings. If you would prefer not to be photographed, please let Sue know before the retreat begins.
5.0 General
5.1 Your Consumer Rights
Nothing in these terms limits any rights you have under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that cannot lawfully be excluded. Where the law does not allow a particular limitation or exclusion, it applies only to the extent the law allows.
5.2 Governing Law
These terms are governed by the laws of New Zealand, and any dispute will be subject to the jurisdiction of the New Zealand courts.
